A person rents out his apartment or house so that he can have a steady source of income. Unfortunately, some tenants abuse tenant rights and refuse to pay the rent after a point of time. If you are facing similar problems with your tenant, then you can breathe easy as here is what you can do to get your space back legally. Here is a brief description of florida eviction procedures.

Once you see that the tenant just refuses to pay you the rent even after repeated requests then contact a lawyer who will serve the tenant a three day notice to leave the premises on your behalf. Remember, that the three days should exclude the weekends and other public holidays. This is important because it shows that you have done all you could before taking serious legal action. If the rent is paid after this, well and good, if not, then you go to the court.

The complaint has to be filed in the court along with the necessary document like from when the tenant was staying in the premises and for how long has he been a defaulter. The copy of the three day notice also has to be produced. After the magistrate goes through them, summons will be sent to the tenant to appear within five days. If the tenant does not appear, then the sheriff is ordered to evict the tenant from the premises and give the property owner his right. If he appears, then he is asked to put forward his case and the decision is taken after hearing both the parties.

The case might take another turn depending on the complexities of a particular case but in basic, here are the general aspects of florida eviction procedures.
